Welcome and thank you very much for considering the submission of your article to the 8 newspapers, ‘Taiwan Times,’ ‘Sumai Times,’ ‘Malaysia Times,’ ‘Kaibigan,’ ‘Shuwe Bamar,’ ‘Giao Lu'u,’ ‘Media Nuansa Indonesia,’ ‘Maitreyi India,’ (hereafter “Newspaper”) published by NEWCOM, and this website managed by NEWCOM (hereafter “Website”).
On using this posting service (hereafter “Service”), please read the following terms and conditions, and submit your posting only if you agree with the provisions set forth. These terms and conditions may be changed without notice, so please confirm the latest contents.
NEWCOM truly looks forward to receiving your postings (press release, information provision). A gift will be presented for articles which are accepted and posted.
Terms and Conditions for Article Postings Service
Article 1 Posted Articles
Article contents shall be related to country or region of requested posting, or stating the Relationship with Japan and the country or region of requested posting. However, posting of articles of prejudiced principles and opinions are prohibited. Posting can be written in any language.
Article 2 Poster
Posters are individuals and groups inside/outside Japan. However, antisocial groups and individuals are excluded.
Article 3 Posting
Posters shall post articles with their own good intentions, legitimate and social appropriateness, and be held responsible for the posting contents. This responsibility is to be continued after the copyright being transferred to NEWCOM. When a poster violates the terms and conditions, NEWCOM can order a posting prohibition suspension without notifying such poster. If the posted article is accepted and to be used, NEWCOM will contact the poster. Please note that the poster will not be notified if article is unaccepted,
and its reasons will not be given.
Article 4 Posting Agreement
Articles which have been decided to be posted shall be posted to newspaper or website, or both, which the poster is assumed to have agreed with.
Article 5 Copyright
Copyright of posted articles are transferred from the poster to NEWCOM at the time of posting. If social or economic benefits are induced by the posted articles, such benefits shall belong to NEWCOM. Please also note that posted articles may be translated into the native language of the posted newspaper.
Article 6 Change/Addition/Deletion of Posted Article Contents
When NEWCOM posts a submitted article, it has the right to partly change, add, and delete the contents. In such cases, the poster shall make no demur. However, if content of submitted article is to be largely changed, NEWCOM will notify the poster. In this cases as well, agreement shall not be required for partial change, addition, and deletion of article contents.
Article 7 Management of Posted Articles
NEWCOM shall legitimately and appropriately manage the posted articles with good managerial intentions.
Article 8 Service Change and Discontinuation
NEWCOM may change or discontinue (temporarily or for long term) this Service without notifying its members.
Article 9 Prohibitions
Posting/submission of articles which fall under the following items are prohibited:
・Articles infringing the copyright of third parties (all of which were posted such as image, text, etc.).
Also, to post articles whose copyright are possessed by third parties.
・Articles which induce portrait rights of people captured in the picture image.
・Articles offending laws and regulations inside/outside Japan, or those which have the potential to do so.
・Articles infringing public welfare, public order and morals.
・Antisocial articles
・False/fabricated articles
・Articles considered to damage our company’s benefit and honor.
・Articles which have harmful programs such as viruses.
・Articles citing or reproducing articles posted to newspaper and website without permission.
Article 10 Exemption from Liability
NEWCOM shall not be held responsibility for the following items:
・Any damage induced by the occurrence of force majeure to the poster by using the posting service
(including physical, financial, and mental distress).
・Posted articles are posted legitimately and with social appropriateness through good intentions of groups and individuals,
hence, NEWCOM shall assume no responsibility for any damage induced to members
and users if articles violating these are posted.
・NEWCOM shall not be held liable for any loss induced to poster by garbling of characters,
etc., of posted articles.
・NEWCOM may not be able to support the posting depending on the language used.
NEWCOM shall not be held responsible for any loss induced to poster in such cases.
Article 11 Responsibility to Third Parties
NEWCOM shall assume no responsibility of damage induced to NEWCOM newspaper readers or NEWCOM website viewers by posted articles. In such cases, poster of article shall be the main party and make effort for a smooth settlement with newspaper readers or website viewers.
Article 12 Protection of Poster's Personal Information
Shall conform to separately specified Privacy Policy.
Article 13 Changes to Usage Terms and Conditions
NEWCOM may change this usage terms and conditions without prior notice to posters. However, critical changes shall be notified to posters either on newspaper or website.
Article 14 Indemnity
In the event that a poster induces damage to NEWCOM by violating any of the provisions set forth in these terms and conditions, such poster shall be liable for any damages regardless of it being accidental or by negligent.
Article 15 Governing Laws and Court of Jurisdiction
Tokyo Summary Court or the Tokyo District Court shall be the exclusive competent court of the first instance for conflicts related to these terms and conditions, which members and users are assumed to have agreed to.
These terms and conditions are in effect as of 5 December, 2008.
